Welcome to Kasero, a global home-swapping community built exclusively for educators.

These Terms of Use (“Terms”) form a binding agreement between you (“you”, “User”, “Member”) and Kasero LLC, a Delaware limited liability company (“Kasero”, “we”, “our”, or “us”), governing your use of the Kasero platform and related services (the “Platform”). Please read these Terms carefully, as they affect your legal rights and obligations.

By accessing or using any part of the Platform—including browsing, listing, messaging, or booking—you confirm that you have read, understood, and agree to be legally bound by these Terms and by all other policies referenced herein, including our Privacy Policy, Cookie Policy, and Disclaimer. If you do not accept these Terms, you are not authorized to use Kasero.

1. About These Terms

These Terms govern your relationship with Kasero LLC and your use of the Platform, available at https://www.kasero.co, including its associated domains, tools, mobile features, and services.

The Platform serves as a neutral digital venue where verified educators can list and exchange their residential homes with one another on a credit-based, non-commercial basis. Kasero does not function as a real estate broker, agent, insurer, property manager, travel agency, or guarantor. It does not mediate transactions between Members or offer financial services.

These Terms form the entire agreement between you and Kasero concerning your use of the Platform. Supplemental terms may apply to certain features (e.g., promotions, surveys), and will be presented at the time they apply. In the event of conflict, these Terms shall prevail unless explicitly stated otherwise.

We reserve the right to amend these Terms from time to time. All changes are effective upon posting unless otherwise specified. We will notify users of material updates via email or Platform notices. Your continued use of the Platform following such changes constitutes acceptance.

2. Legal Structure

Kasero LLC is a limited liability company incorporated in the State of Delaware, United States. All contractual obligations, legal notices, disclaimers, and risk allocations herein are governed by and construed under the laws of Delaware, without regard to its conflict-of-law rules.

Nothing in these Terms shall be construed as creating a joint venture, partnership, employment, or agency relationship between you and Kasero. Each party remains independent and fully responsible for its own acts, omissions, and liabilities.

Kasero does not employ, contract, or engage any Members—whether Hosts or Guests—as agents, representatives, employees, or independent contractors. All Members participate on a purely voluntary basis, and no compensation or service relationship is formed between Kasero and any Member as a result of hosting, traveling, or participating in the Platform.

3. Agreement to Terms & Binding Effect

By accessing or using the Platform, you affirm that you:

Have read and understood these Terms;
Have full legal capacity to enter into binding agreements;
Are not prohibited by applicable laws or sanctions from using the Platform;
Are acting in your personal capacity as an individual educator and not as a representative of a commercial entity or in any business capacity;
Accept and agree to be bound by these Terms, including the disclaimers, limitations, waivers, and arbitration clause set forth herein.

If you do not agree to these Terms in full, you may not access or use the Platform. No partial or conditional acceptance is permitted.

Use of the Platform is at your own risk. Kasero disclaims all liability for your participation in any home exchange, reliance on user content, or interactions with other Members. The Platform is provided strictly “as-is” and “as-available,” without warranties of any kind.

4. Eligibility to Use the Platform

Access to Kasero is strictly limited to:

Individuals aged 18 years or older; and
Currently employed educators, defined as full-time or part-time teachers, administrators, counselors or academic staff affiliated with accredited institutions. Kasero reserves the right to expand, narrow, or otherwise modify eligibility criteria from time to time at its sole discretion.

By registering or using the Platform, you represent and warrant that:

You are a natural person (not a company or organization);
You are actively employed in an educational role, and can verify your status;
You have not been previously suspended or removed from the Platform;
You are not listed on any U.S. or international sanctions or prohibited party lists;
You are not located in any jurisdiction subject to comprehensive U.S. trade embargoes.

Kasero reserves the right to deny access, suspend accounts, or restrict use of the Platform at its sole discretion, including but not limited to cases of misrepresentation, fraud, or violation of these Terms.

We reserve the right to request additional verification at any time, including proof of identity, teaching affiliation, or geographic location.

5. Account Registration & Identity Verification

To participate in the Platform, you must create a Kasero account. During registration, you must provide:

A valid name and email address;
A password that you will keep secure;
Sufficient evidence of your educator status (e.g., school email, official website, LinkedIn profile).

You agree to provide only truthful, current, and complete information. Falsifying information or impersonating others is grounds for immediate account termination.

Account registration is limited to one account per educator. Multiple accounts, shared accounts, or group registrations are not permitted.

Verification Process

Kasero may use automated and manual methods to verify your teaching status and identity. This may include document reviews, social profile checks, domain verification, and outreach to your affiliated institution.

You agree that Kasero may retain verification data for compliance, fraud prevention, and security purposes, subject to our Privacy Policy.

You are responsible for all activity under your account, including any actions taken by others using your credentials. You agree to notify us immediately of any unauthorized use. Kasero is not responsible for losses resulting from compromised access credentials.

We may reject or revoke account access at any time and for any reason, including but not limited to suspected fraud, abusive behavior, or failure to meet eligibility requirements.

6. Membership Structure

Kasero currently operates on a free, single-tier membership model. Upon acceptance, eligible users may join the Platform at no cost.

Membership includes:

Full access to the Kasero Platform;
The ability to host and stay with other verified educators;
An initial credit allocation upon successful registration and verification, in accordance with Kasero's published credit and reward structure (which may include welcome bonuses, referral rewards, and other promotional credits), all subject to the eligibility requirements, limits, and conditions described on the Platform;
Continued participation in the credit exchange network.

Important Conditions:

Credits hold no cash value, cannot be purchased, and are not redeemable for money or external benefits.
Kasero does not process or hold payments between users. All exchanges are strictly non-monetary.
Membership does not confer ownership, voting rights, or equity interest in Kasero or its Platform.

Kasero reserves the right to introduce paid features, premium tiers, or membership fees in the future at its sole discretion. Any such changes will not apply retroactively, and Members will be given the option to accept the new terms or close their account.

7. Platform Services and Limitations

Kasero is a peer-to-peer platform designed exclusively for verified educators to list and exchange their homes on a non-commercial, non-monetary basis.

The Platform enables users to:

Create and manage home listings;
View listings created by other verified members;
Communicate with potential guests or hosts via in-platform messaging;
Book stays using Kasero's internal credit system;
Manage their calendar, availability, and profile settings.

Kasero does not:

Broker, mediate, or enforce agreements between Members;
Accept or hold payments, deposits, or security funds on behalf of users;
Verify the safety, quality, legality, condition, or availability of any property;
Provide insurance, guarantees, damage protection, or financial remedies;
Vet users beyond the initial educator verification process;
Act as a real estate agent, property manager, or landlord under any jurisdiction.

All arrangements are made directly between Members. The Platform serves solely as a facilitation tool.

You acknowledge and agree that any stay you host or attend is entered into voluntarily, at your sole risk, and that Kasero has no control over, and disclaims all liability for, the behavior, representations, condition, or omissions of any user or property.

8. Community Principles and Acceptable Use

Kasero is founded on mutual respect, trust, and shared values among educators worldwide. Every Member is expected to uphold this standard when engaging with the Platform and with one another.

As a condition of use, you agree to:

Treat all Members with professionalism and respect;
Respond to hosting or stay requests in a timely and clear manner;
Maintain open and honest communication regarding availability, expectations, and property conditions;
Not discriminate against users based on race, ethnicity, nationality, religion, gender, disability, sexual orientation, age, or any other protected status;
Avoid engaging in any conduct that undermines the safety, trust, or dignity of other Members.

You further agree not to:

Use Kasero for commercial purposes, including promoting rentals or unrelated services;
Post false, misleading, or deceptive information;
Circumvent the credit system or platform tools to arrange off-platform exchanges;
Share your login credentials or operate multiple accounts;
Engage in any form of harassment, defamation, stalking, or abuse;
Introduce viruses, malicious code, scraping bots, or engage in unauthorized data collection.

Kasero reserves the right to suspend or terminate any account that violates these principles, with or without notice, and with the immediate forfeiture of any accumulated credits.

9. Listings: Accuracy and Member Obligations

When you create a listing on Kasero, you represent and warrant that:

You are the legal owner or have lawful occupancy rights to the property;
You have obtained all necessary permissions (including landlord approval, if applicable);
You have reviewed and are in compliance with any relevant zoning, short-term use, or local housing laws;
You have appropriate home or renter's insurance covering the property during stays.

Each listing must include accurate, complete, and non-misleading information, including:

Location (generalized for privacy until confirmed);
Photos and a truthful description of the space and amenities;
Sleeping capacity;
House rules or restrictions (e.g., no smoking, no pets);
Available dates and blackout periods.

You are responsible for updating your calendar regularly to avoid scheduling conflicts or failed bookings.

You agree not to:

Post multiple listings for the same property;
Include external links, contact details, or off-platform booking mechanisms;
Use copyrighted images without permission;
Withhold material information that may affect a guest's stay or safety.

Kasero reserves the right to remove or edit any listing that violates these Terms, creates potential liability, or disrupts the community.

10. Booking Process and Role of the Platform

The Kasero booking process operates as follows:

A Guest Member submits a stay request to a Host Member. Kasero verifies that the Guest holds sufficient credits to complete the requested stay, but no credits are debited from the Guest's account at the time of submission;
The Host Member reviews and either accepts or declines the request;
Once the Host accepts the request, the booking is confirmed between the two Members and the applicable credits are immediately and irrevocably transferred from the Guest's account to the Host's account, subject only to the cancellation rules described elsewhere in these Terms and on the Platform. Kasero does not hold credits in escrow.

Mutual Swap Proposals. In addition to one-way stay requests, the Platform supports mutual swap proposals, in which two Members agree to host one another during specified date ranges. A mutual swap consists of two paired stays, each with its own dates, listing, and credit cost. The net credit transfer between the two parties at the time of acceptance is determined by the difference between the two legs' credit costs, calculated in accordance with Kasero's published nightly-rate structure. Mutual swap proposals are subject to the same eligibility, acceptance, cancellation, and dispute rules described in these Terms and on the Platform, modified only as expressly stated in the in-Platform terms applicable to mutual swaps.

Response Window. Booking requests and mutual swap proposals that are neither accepted nor declined by the recipient within the response window published on the Platform (currently seventy-two (72) hours from submission) will automatically expire. The submitting Member may resubmit a new request after expiry.

Concurrent Request Limits. To preserve fairness and prevent over-commitment, Members may be limited in the number of overlapping pending booking requests they may have outstanding at any time. Current limits are published on the Platform and may be updated by Kasero from time to time.

Bookings are not binding until the Host confirms the request. Hosts retain full discretion to accept or decline any booking without explanation.

Cancellation Consequences. A booking or mutual swap that is cancelled after acceptance may, depending on the timing and circumstances of the cancellation, result in (i) a full or partial refund of credits to the Guest, (ii) a credit penalty deducted from the cancelling party and credited to the non-cancelling party as compensation for the disruption to their plans, (iii) the cancelled dates being held against the cancelling party's calendar, and/or (iv) the creation of an internal Kasero administrative record. The specific timing windows and credit consequences are described on the Platform and may be updated by Kasero from time to time. By using the Platform, you agree to be bound by the cancellation rules in effect at the time of your cancellation. Internal administrative records arising from cancellations are maintained for platform-integrity purposes only, are accessible solely to Kasero personnel, and are not published or surfaced to other Members.

Kasero does not guarantee that:

A listed home will be available;
The listing will match expectations;
The host will accept any specific booking;
Either party will comply with their promises.

Members are expected to communicate clearly, confirm logistics, and disclose important information before finalizing arrangements. Guests and Hosts are encouraged to maintain all booking-related communication on the Platform for safety and record-keeping.

Kasero is not responsible for cancellations, miscommunications, misrepresentations, or failed exchanges. All such risks are assumed by the participating Members.

No relocation or emergency assistance. Kasero is an introductory platform only. In the event of a canceled booking, uninhabitable property, denied entry, or any other emergency, Kasero has no obligation to assist you in finding alternative accommodations, funding hotel stays, or mediating the dispute. All backup travel and lodging plans are solely your responsibility.

11. Credit System: Structure and Terms

Kasero uses a closed-loop credit system for managing stays. The system is designed to ensure fairness and reciprocity without involving cash or external transactions.

Key rules:

The credit cost of a stay is determined by Kasero's published nightly-rate structure, which varies by listing type (e.g., entire-home vs. private-room listings) and by the length of the stay. Current nightly rates are displayed on the Platform at the time of booking and may be updated by Kasero from time to time.
Credits are earned by hosting other Members.
Credits are non-purchasable and non-redeemable for cash.
Each Member may receive an initial credit allocation upon successful account registration and verification, in accordance with Kasero's published credit and reward structure. Welcome bonuses, referral rewards, hosting rewards, and other promotional credits are subject to the eligibility requirements, limits, and conditions described on the Platform, including caps on the total number of qualifying Members, listing-type-specific reward amounts, and qualifying-action requirements.
Credits are tied to your account and may not be sold, traded, or pooled with others.
Kasero does not facilitate peer-to-peer credit transfers between Members. From time to time, Kasero may, at its sole discretion, make administrative credit adjustments to a Member's account — including remedies for misrepresentation, corrections of operational errors, or promotional grants. Such adjustments are not requestable as of right and are not commitments to any future remedy.
Account Inactivity: To maintain the active quality and responsiveness of the network, Kasero reserves the right to expire unused credits and/or suspend public listings on accounts that have been completely inactive (no logins or platform activity) for a period of twelve (12) consecutive months.

Credits are not a financial product, loyalty currency, or virtual asset. They are a symbolic internal unit with no monetary value and no legal claim outside the Platform.

Unused credits expire upon account closure or termination. Credits do not roll over to third-party beneficiaries (including heirs or legal representatives).

You understand and agree that your participation in the credit system is voluntary, and Kasero assumes no liability for the value, use, or loss of credits.

Platform Discontinuation: In the event that Kasero pauses operations, merges, or permanently shuts down the Platform, all outstanding credits will immediately become void. You acknowledge that Kasero bears no liability for unused credits upon platform dissolution.

12. Platform Disclaimers and Risk Allocation

To the maximum extent permitted by applicable law, you agree that your use of the Platform is entirely at your own risk. Kasero provides access to a software toolset that facilitates discovery and communication between Members. We do not own, inspect, insure, supervise, manage, or control any properties or users.

Accordingly, Kasero disclaims all liability arising from or relating to:

Misrepresentations in listings;
Property condition, safety hazards, or amenity defects;
Cancellations, no-shows, or early departures;
Loss, theft, or damage to property or belongings;
Personal injuries, accidents, or death occurring during a stay;
Violations of applicable law by users;
Unlawful or inappropriate behavior by any Member or their guests.

No background checks. Kasero is not responsible for the conduct of any user. Kasero does not conduct criminal background checks, sex offender registry checks, or character assessments on its members. You are solely responsible for taking reasonable precautions and conducting your own due diligence before interacting with, hosting, or staying with any other member.

No advice, information, or communication from Kasero—whether oral, written, or via the Platform—shall create any warranty, representation, or legal obligation not expressly stated in these Terms. Kasero makes no guarantees regarding Platform availability, uptime, accuracy of listings, or search results. We reserve the right to modify or discontinue features at any time without notice or liability. Users are solely responsible for conducting their own due diligence and taking all necessary precautions when engaging with other Members or offering access to their home.

13. Kasero Is Not a Rental Platform

Kasero is not a property rental service, broker, or facilitator of commercial transactions. It is a peer-to-peer community platform where verified educators voluntarily exchange residential accommodations without monetary consideration.

Accordingly:

No payments, fees, deposits, or rent are transacted between Members;
No tenancy, subletting, lease, or landlord-tenant relationship is created between any parties through the Platform;
Members do not receive compensation, income, or profit from hosting others;
Kasero does not act as an agent for any user and is not a party to any exchange.

By using the Platform, you acknowledge that all exchanges are voluntary, non-commercial agreements between private individuals. Kasero plays no role in negotiating or enforcing these arrangements.

Any attempt to monetize stays, demand fees, or circumvent the credit model will result in immediate suspension or termination of the account, without refund.

Exception for Damage Resolution: The prohibition on monetary transactions does not apply to good-faith, post-stay settlements negotiated directly between Members to reimburse a Host for actual property damage, lost items, or extraordinary cleaning fees caused by a Guest. Kasero does not facilitate, mediate, or guarantee these damage settlements, and any such payments are made strictly off-platform at the Members' own risk.

14. User-to-User Relationship & Platform Immunity

When two Members agree to an exchange, they enter into a private agreement between themselves. Kasero is not a party to, beneficiary of, or liable for any term of that agreement.

Kasero does not:

Supervise, monitor, or validate the conduct or reliability of users;
Guarantee the availability, cleanliness, or suitability of any accommodation;
Intervene in user disputes except in limited moderation circumstances.

Users are fully and solely responsible for their own decisions and interactions. You agree that Kasero shall not be held liable, under any theory of law, for:

Failed or canceled bookings;
Losses or damages suffered during a stay;
Legal or regulatory consequences of an exchange;
Misconduct, negligence, or omissions of any Member or their guests.

Safe harbor. Kasero claims all protections afforded by Section 230 of the Communications Decency Act and international equivalents. We are not the publisher or speaker of any information provided by another information content provider.

This section survives the termination of your account or cessation of Platform use.

15. Assumption of Risk

By participating in a home exchange, you fully acknowledge and accept the inherent risksassociated with:

Hosting unknown individuals in your home;
Staying in a property you do not own or control;
Potential exposure to safety hazards, allergens, pets, or environmental conditions;
Interacting with guests from different regions, cultures, or risk profiles.

You agree to assume all risks, known and unknown, foreseeable or unforeseeable, associated with your use of the Platform and participation in exchanges.

You also understand that Kasero:

Does not inspect properties;
Does not verify safety compliance;
Does not guarantee outcomes or experiences.

You waive any claims against Kasero for personal injury, property damage, emotional distress, or economic loss arising out of your use of the Platform or participation in any exchange.

Traveling with Minors: If you travel with children or dependents, you assume full, sole responsibility for their safety, supervision, and actions during the stay. You acknowledge that Host properties are private, individual residences and are not required to be child-proofed or compliant with commercial safety standards for minors.

16. Insurance & Home Use Declarations

As a condition of using Kasero, all Members represent and warrant that:

You have valid and active homeowners or renters insurance covering the property you list;
If you are a tenant, you have obtained permission from your landlord or property manager to participate in home exchanges;
INSURANCE EXCLUSION AWARENESS: You expressly acknowledge that standard homeowners or renters insurance policies may not cover property damage, liability, or theft arising from a peer-to-peer home exchange. It is your sole responsibility to secure a specialized policy, rider, or short-term rental endorsement. Kasero provides zero property or liability coverage and will not intervene in, facilitate, or act as a party to any insurance claim.
You will disclose any material risk to guests, such as:
- Presence of pets
- Surveillance devices (e.g., doorbell cams)
- Hazards or restrictions (e.g., steep stairs, pool, allergens)

Kasero may, at its discretion, request evidence of insurance or written landlord permission. Failure to provide such documentation may result in listing suspension or account deactivation.

You agree that Kasero bears no responsibility for verifying your insurance status or compliance with lease terms, local zoning laws, condo bylaws, or homeowners' association rules.

17. Legal Compliance and Local Laws

You are solely responsible for ensuring that your participation on Kasero complies with all applicable laws, regulations, and ordinances in your jurisdiction, including but not limited to:

Short-term rental or exchange restrictions;
Zoning and housing codes;
Condominium, HOA, or co-op rules;
Tax or registration requirements;
Health, safety, and occupancy standards.

Kasero does not provide legal advice or compliance guidance and makes no warranties regarding your ability to lawfully participate in home exchanges. If required by local law, it is your responsibility to:

Obtain permits or approvals;
Pay occupancy taxes or regulatory fees;
Register your property or activity with the appropriate authority.

Tax indemnification. You acknowledge that local authorities may deem home exchanges, including credit-based stays, as taxable events. Kasero does not collect, remit, or report any occupancy taxes, transient lodging taxes, VAT, or income taxes on your behalf. You agree to indemnify and hold Kasero harmless from any tax liabilities, penalties, or audits resulting from your use of the Platform.

Kasero disclaims all liability for any fines, enforcement actions, or disputes resulting from noncompliance with local laws.

18. Property Damage, Injury & Waiver of Claims

You understand and agree that by hosting or staying in another Member's home, you may encounter:

Accidental or intentional property damage;
Injury to yourself or your guests;
Theft, loss, or destruction of personal property;
Exposure to unfamiliar environments, weather, or hazards.

Kasero is not liable for any such harm or loss.

By using the Platform, you waive, to the fullest extent permitted by law, any and all claims, actions, damages, or causes of action against Kasero arising from:

Damage to or loss of property;
Personal injury, illness, emotional distress, or death;
Criminal acts, negligence, or omissions by other users;
Misuse or malfunction of property, fixtures, or appliances.

You are solely responsible for securing your own safety, personal belongings, and risk mitigation (including securing valuables, conducting inspections, and maintaining appropriate insurance).

Kasero does not offer any form of host guarantee, reimbursement, or platform-sponsored damage protection.

19. Acceptable Use Policy

To preserve trust and integrity within the Kasero community, all users are required to comply with this Acceptable Use Policy.

You agree not to use the Platform:

To engage in or promote any unlawful, harmful, or fraudulent activity;
To impersonate any person or entity, or misrepresent your affiliation;
To upload, transmit, or distribute viruses, malware, or malicious code;
To harvest, scrape, or collect user data or listings using automated tools;
To reverse-engineer, disrupt, or attempt to compromise the Platform's functionality;
To solicit other users for off-platform transactions or to circumvent the credit system;
To post, upload, or transmit any content that is:
- Defamatory, obscene, harassing, or abusive;
- Violent, threatening, or inciting harm;
- Discriminatory based on race, religion, sex, disability, or other protected status;
- In violation of another's intellectual property or privacy rights.

Kasero reserves the right to monitor usage and content for compliance and to take enforcement action at its sole discretion. This includes warnings, content removal, account suspension, or permanent termination—without refund or notice.

20. Suspension, Termination & Account Closure

Kasero may suspend or permanently terminate your access to the Platform at any time, without notice, if we reasonably believe that:

You have violated these Terms or other posted policies;
You provided false, misleading, or fraudulent information;
Your behavior undermines the trust, safety, or integrity of the Platform;
You are engaged in off-platform dealings or attempts to monetize stays;
Your property or actions present an unacceptable risk to other Members;
Legal or regulatory concerns necessitate your removal.

Account termination may include:

Removal of your profile and listings;
Cancellation of upcoming bookings;
Forfeiture of any remaining credits;
Loss of membership benefits and permanent forfeiture of all credits.

You may voluntarily request account closure by contacting support. Upon closure:

All future bookings will be canceled;
Credits and membership benefits are permanently forfeited;
Certain provisions (e.g., disclaimers, indemnities, governing law) will survive.

Kasero has no obligation to retain, return, or export your data post-termination.

21. Intellectual Property Rights

All materials on the Platform—including software, design, logos, graphics, trademarks, and text—are the intellectual property of Kasero or its licensors and are protected by U.S. and international intellectual property laws.

You may not:

Copy, reproduce, modify, publish, republish, transmit, display, sell, or create derivative works from any part of the Platform;
Use Kasero's trademarks or branding without prior written consent;
Frame, mirror, or scrape the Platform or any of its content;
Use our name or materials in meta tags, ads, or marketing without express authorization.

You are granted a limited, revocable, non-transferable license to access and use the Platform solely in accordance with these Terms.

Any rights not expressly granted are reserved.

22. User Content and License Grant

You may submit or upload content to the Platform, including:

Listings and descriptions;
Photos and images;
Calendar availability;
Messaging history;
Reviews and ratings.

By submitting such content, you represent and warrant that:

You own or have the right to use and share the content;
The content does not violate any third-party rights, including copyright, privacy, or contract rights;
The content is truthful, not misleading, and compliant with applicable laws.

You grant Kasero a worldwide, royalty-free, sublicensable, perpetual, irrevocable license to use, reproduce, host, display, publish, distribute, and modify your content for purposes of operating and promoting the Platform.

Kasero may, at its discretion, remove or moderate user content that:

Violates these Terms or applicable laws;
Is flagged as inaccurate, offensive, or fraudulent;
Creates risk or legal exposure to the Platform or other users.

Kasero assumes no liability for user-submitted content and is under no obligation to pre-screen or monitor submissions.

23. DMCA & Copyright Policy

If you believe that content on the Platform infringes your intellectual property rights, you may submit a notice under the U.S. Digital Millennium Copyright Act (DMCA).

Your DMCA notice must include:

Your physical or electronic signature;
A description of the copyrighted work you claim is infringed;
A description of the material you believe is infringing;
The exact URL or location of the content in question;
Your name, address, email, and telephone number;
A statement under penalty of perjury that the information is accurate, and that you are authorized to act on behalf of the copyright holder.

24. Warranty Disclaimer

Your use of the Platform is entirely at your own risk.

To the maximum extent permitted by law, Kasero disclaims all warranties, express or implied, including:

Warranties of merchantability, fitness for a particular purpose, or non-infringement;
Warranties regarding the quality, condition, legality, or safety of any listed property;
Warranties of accuracy, completeness, or reliability of listings, profiles, or user content;
Warranties regarding uninterrupted or error-free access to the Platform.

Kasero does not guarantee that:

Any user will honor a booking or stay;
Any home will meet expectations or be free from defects or hazards;
Communications will be secure or uninterrupted;
The Platform will be free from viruses, security breaches, or data loss.

Some jurisdictions do not allow the exclusion of certain warranties. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

25. Limitation of Liability

To the maximum extent permitted under applicable law, Kasero LLC, its officers, directors, affiliates, employees, licensors, contractors, and agents (“Kasero Parties”) shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages, whether in contract, tort (including negligence), warranty, strict liability, or otherwise, arising out of or in connection with:

Your use of or inability to use the Platform;
Your participation in or reliance on any exchange;
Personal injury, death, or property damage;
User conduct, misrepresentations, or omissions;
Suspension, termination, or deletion of your account;
Platform downtime, bugs, unauthorized access, or security breaches.

This includes any damages for loss of profits, data, goodwill, substitute services, or other intangible losses, even if we were advised of the possibility. Our total cumulative liability to you shall not exceed the greater of: (a) one hundred U.S. dollars ($100); or (b) the amount you paid to Kasero, if any, in the past twelve (12) months preceding the claim.

California waiver. If you are a California resident, you waive California Civil Code Section 1542, which says: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”

Some jurisdictions may not allow certain limitations of liability. In such cases, our liability will be limited to the fullest extent permitted by law.

26. Indemnification

You agree to fully indemnify, defend, and hold harmless Kasero LLC and its affiliates, officers, employees, and agents from and against any and all losses, damages, claims, liabilities, demands, actions, suits, expenses, and costs (including reasonable legal fees) arising out of or relating to:

Your use of the Platform or participation in any exchange;
Your breach of these Terms or any applicable law;
Your violation of the rights of another person or entity;
Your content, communications, conduct, or listing;
Any claim by a Guest or Host related to a dispute, injury, or incident at a property.

You acknowledge that Kasero is not responsible for mediating or resolving any dispute, damage, or complaint between Hosts and Guests. All such matters are strictly between the participating Members, and you agree not to involve Kasero in any demand, claim, or legal process related to those arrangements.

Kasero reserves the right to assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate fully in any such defense.

27. Dispute Resolution (User vs. Kasero Only)

A. No Role in Host-Guest Disputes

Kasero is not a party to, and will not mediate or resolve, any dispute between a Host and a Guest. All claims, demands, or disagreements arising out of an exchange must be resolved directly between the participating Members.

B. Disputes Between You and Kasero

Although unlikely, if any dispute arises between you and Kasero LLC regarding these Terms or your use of the Platform, the following steps shall apply:

Good-Faith Negotiation (30 Days) — You agree to first attempt to resolve the dispute informally by emailing legal@kasero.co. Both parties must engage in good-faith efforts to resolve the matter within 30 calendar days.
Mediation (Optional, Encouraged) — If unresolved after 30 days, either party may submit the dispute to non-binding mediation administered by a mutually agreed-upon mediator.
Arbitration (Mandatory) — If the dispute remains unresolved, it shall be submitted to final and binding arbitration administered by the American Arbitration Association (AAA), under its Commercial Arbitration Rules.
- Arbitration shall take place in Delaware, in English, and before a single neutral arbitrator.
- Each party shall bear its own legal fees, unless otherwise ordered by the arbitrator.
- The arbitrator's decision will be final and enforceable in any court of competent jurisdiction.
Small Claims Court Exception — Notwithstanding the mandatory arbitration agreement above, either you or Kasero may elect to bring an individual action in a small claims court of competent jurisdiction if the claim qualifies and remains solely within that court's jurisdiction.

C. No Class Actions or Jury Trials

You waive any right to:

Participate in a class, collective, or representative action;
Seek jury trial in any dispute with Kasero.

Only individual claims may be arbitrated.

28. Governing Law

These Terms shall be governed exclusively by the laws of the State of Delaware, United States, without regard to conflict-of-law principles.

Subject to the arbitration clause above, any claim that is permitted to proceed in court shall be brought solely in the state or federal courts located in Delaware, and you irrevocably consent to the jurisdiction and venue of those courts.

29. Miscellaneous

Entire Agreement. These Terms, along with our Privacy Policy and any supplemental policies referenced herein, constitute the entire agreement between you and Kasero and supersede all prior understandings.
Severability. If any provision is deemed unenforceable, the remaining provisions will remain in full force and effect.
No Waiver. Failure by Kasero to enforce any right shall not constitute a waiver of that right or any other.
Assignment. You may not assign your rights under these Terms without our prior written consent. We may assign these Terms freely in connection with a merger, sale, or restructuring.
Force Majeure. Kasero shall not be liable for any delay or failure in performance resulting from causes beyond our reasonable control, including acts of God, natural disasters, war, cyberattacks, or telecommunications failures.
